Terms of Service
Article 1 (Purpose) The purpose of this Terms of Service (hereinafter referred to as “Terms”) is to stipulate the rights, obligations, and other necessary matters of the Company and users in using the services provided by PINE MUSE Inc. (hereinafter referred to as the "Company"). Article 2 (Definitions) The definitions of terms used in these Terms are as follows: 1. "Member(s)" means a person who has provided personal information to the Company to receive services, registered as a Member, and has been granted a Member ID. 2. "ID" means a combination of letters (including special characters) and numbers selected by the Member and verified and approved by the Company for the identification of the Member and the Member's use of the Company's homepage. 3. "Password" means a combination of letters (including special characters) and numbers determined by the Member to confirm that the Member is a Member matching the ID assigned to him or her and to protect the Member's own personal information. Article 3 (Obligations of the Company) 1. The Company shall endeavor to provide services continuously and stably asstipulated in these Terms and shall not engage in acts prohibited by the relevant laws and conditions and these Terms, or acts contrary to public order and morals. 2. The Company establishes a security system to protect the personal information of Members so that Members can use the service safely and announces and complies with the personal information protection policy. 3. The Company strives to provide convenience to Members in the procedures and contents of contractual relations with Members, such as the conclusion of the contract of use, the modification and termination of contract matters, etc. If a Member applies for withdrawal, the withdrawal will be processed immediately. 4. If the opinions or complaints raised by the user are objectively recognized as legitimate, the Company shall immediately handle them through appropriate procedures. Provided that if it is difficult to process immediately, the user shall be notified of the reason and the processing schedule. Article 4 (Member's Obligations) 1. Members shall comply with the matters stipulated in these Terms, the matters notified or notified by the Company, and related laws and regulations, and shall not engage in acts that interfere with the Company's business or damage the Company's reputation. 2. Except for cases where the Company is responsible for the Company in accordance with relevant laws and privacy policies, the Member is responsible for all consequences caused by negligence or illegal use of the Member's ID and Password. 3. Members shall not use the Services to conduct business activities without the prior consent of the Company, and the Company shall not be liable for any damages incurred in relation to the transactions of goods between Members or between Members and third parties, and profits expected subjectively in connection with the use of services. If the Company suffers damages due to such business activities, the Member shall be obliged to compensate the Company for damages, and the Company may request restrictions on the use of services and compensation for damages against the Member. 4. Members may not transfer or gift the right to use the service or other status under the contract of use to others without the express consent of the Company, and cannot provide it as collateral. 5. When applying for Membership or changing Member information, the user shall fill out all matters based on the facts under his or her real name, and cannot claim any rights if false or other people's information is registered. 6. If the contents of the contract of use, such as e-mail address, are changed, the Member shall immediately notify the Company through the relevant procedure. 7. Members shall not infringe on the intellectual property rights of the Company and third parties. 8. Members shall not engage in any of the following acts, and in such acts, the Company may restrict or sanction the use of the Member's services. (1) Registering false contents when applying for Membership or changing Member information (2) Stealing personal information such as another Member's ID, Password, etc. (3) Trading Member ID with others (4) Impersonating the Company's management, employees, or related persons (5) Changing the client program of the homepage, hacking the server, or arbitrarily changing part or all of the homepage or posted information without being granted due authority by the Company. (6) Acts that interfere with the smooth provision of services by the Company (7) The act of reproducing information obtained through the Service for purposes other than using the Service without the prior consent of the Company, using it for publication, broadcasting, etc., or providing it to a third party. (8) In case of transmitting, posting, or otherwise distributing content that infringes the copyright of the Company or a third party to others (9) Transmitting, posting, or otherwise distributing vulgar or obscene content to others that violates public morals; (10) Transmitting, posting, or otherwise distributing content that may infringe on the honor or privacy of others; (11) Insulting or threatening other users, causing pain or inconvenience; (12) Collecting or storing other users' personal information without the approval of the Company (13) Acts that are judged to be criminal (14) Acts that violate all regulations or conditions of use set by the Company, includingthese Terms (15) Other acts that violate relevant laws and regulations Article 5 (Effect and Amendment to the Terms) 1. These Terms take effect by notifying Members through the homepage, e-mail, or other means. 2. The policy on personal information protection guided by these Terms applies to all cases of using the Company's services after signing up as a Member. Provided that if you submit an application for selection screening, a separate personal information protection policy may be applied. 3. The Company may amend the Terms to the extent that it does not violate relevant laws such as the Act on the Regulation of Terms, the Framework Act on Electronic Documents and Electronic Transactions, the Electronic Signature Act, and the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. 4. In the event that the Company revises these Terms, it will announce the effective date and the details of the amendment on its homepage from 7 days before the effective date to the day before the effective date. 5. Members may terminate their Membership registration if they do not agree to the amended Terms. Provided that if you continue to use the Service after the effective date of the amended Terms, you will be deemed to have agreed to the amendment to the Terms. 6. The Company shall not be liable for any damage caused by the Member's ignorance of the contents of the amended Terms. Article 6 (Execution of the Contract of Service Use) 1. The contract of service use shall be executed when a person who intends to register as a Member and use the service (hereinafter referred to as "Service Use Seeker") agrees to this Terms and the Company approves it, and the application for use and the Company’s approval shall be in accordance with these Terms. 2. Consent to the Terms shall be deemed to have been made by the applicant expressing his/her intention by clicking the check box “I agree to the above Terms of Service” at the time of Membership registration and clicking the register button or a similar method. 3. Children under the age of 14 shall obtain the consent of their legal representative for the collection and use of personal information by the Company. Article 7 (Application for Use of the Service) 1. The Service Use Seeker shall provide the information requested by the Company (name, e-mail address, Password, etc.). Provided that the personal information provided at this time is only used for the identity verification process and is not collected or stored in any equipment or documents for other commercial purposes other than the purpose of providing services. 2. The Company may require the Service Use Seeker’s identification process for those who wish to use the service. 3. If you steal personal information such as another person's ID, Password, etc. to use the service, you may be punished according to the relevant laws and regulations. Article 8 (Acceptance and Restriction of Application for Use) 1. In principle, the Company approves the use of the service in accordance with the order of receipt for the Member who has applied for use (hereinafter referred to as "Use Application Customer"). 2. The Company may restrict the acceptance of the application for use in any of the following cases, and may suspend the acceptance until the reason for the restriction of acceptance is resolved. (1) In the case that the Company's service-related facilities are not sufficiently equipped (2) In the case that the current technology level of the Company is exceeded (3) In the case that it is deemed necessary due to the Company’s other circumstances 3. The Company may not accept the application for use if it falls under any of the following items. (1) In the case that an application is made for a wrongful purpose (2) In the case of applying using another person's ID (3) In the case that the contents of the application for the contract of use are falsely stated (4) In the case that the application is made for the purpose of hindering public morals (5) In the case that an application is made for the purpose of pursuing profit by means other than those prescribed by the Company (6) In the case that other registration application requirements set by the Company are insufficient. (7) In the case that applications are made by users who are or are likely to be competing with the Company’s service (8) In case of application in violation of other stipulated matters set by the Company 4. In the event that the applicant is a minor as stipulated by the relevant laws and regulations, the Company may withhold consent as stipulated in the service-specific guide. Article 9 (Period of Service Use) 1. In principle, the use of the service is operated 24 hours a day, for year-round, unless there is a special hindrance to the Company. Provided that the Company may suspend services for regular system inspection, expansion, and replacement. 2. The Company may specify the available time separately for each service. Article 10 (Suspension of Service Provision) 1. The Company may restrict or suspend part or all of the service provision in any of thefollowing cases. (1) In case of unavoidable occurrence due to construction, such as maintenance, inspection, replacement, or failure of information and communication facilities (2) In the case that the telecommunication service provider has suspended the telecommunication service (3) In the case that there is an obstacle to the normal use of the service due to excessive use of the service (4) In case of natural disaster, war or other force majeure reasons 2. In the event of suspension of service pursuant to the preceding paragraph, the Company shall notify the reason and period. Provided that exceptions are made when it is remarkably difficult to notify the suspension of services that occur due to reasons beyond the Company's control. Article 11 (Restrictions on Service Use) 1. If a Member violates the contents of the Terms or falls under any of the following items, the Company may restrict the use of the service by the Member. (1) In the case of using profane IDs and nicknames that undermine public morals (2) In the case that it interferes with or insults other users' use of the service (3) In the case that there is a request for correction from a relevant public institution such as the Information and Communication Ethics Committee (4) In the case that you have not used the service for more than 1 year (5) In the case of posting illegal contents such as pornography or infringement of copyright (6) In case of other obstruction of normal service operation 2. In accordance with the above restrictions on use, the Company can suspend, initialize, and terminate the service contract without notice to the Member who uses the service, and the Member is responsible for compensating for the damage caused to the Company or other the Members due to the reasons attributable to the preceding paragraph. Article 12 (Termination of the Member's Contract of Use) If a Member wishes to terminate the contract of use, he or she shall apply for cancellation using the withdrawal function on the Company's homepage. Article 13 (Granting and Changing Member IDs) 1. The Company grants membership IDs to Members in accordance with these Terms. In principle, the Member ID is the email address of the Member determined by the Member during the membership registration process. 2. Members can view and modify their personal information at any time through the homepage. 3. If any of the following applies, the Member ID may be changed at the request of the Member or the Company. (1) When the Member's ID is registered with the Member's phone number or date of birth, etc., and there is a concern about invasion of privacy (2) When it causes disgust to others or violates public order and morals (3) When there are other reasonable reasons 4. Other matters concerning the management and modification of Members' personal information shall be as stipulated in the information for each service. Article 14 (Obligation to Manage Members' IDs and Passwords) 1. Except where the Company is responsible for the management of the Member ID and Password in accordance with relevant laws and privacy policies, the Member is responsible. 2. Members shall not allow a third party to use their ID and Password. 3. If a Member recognizes that his/her ID and Password have been stolen or being used by a third party, the Member shall notify the Company immediately and follow the Company's instructions, if any. 4. The Company shall not be liable for any damages caused to the Member as a result of the Member violating Paragraphs 1, 2, and 3 above. Article 15 (Protection and Use of Personal Information) 1. The protection and use of Members' personal information is subject to relevant laws and regulations, and the Company's privacy policy. Provided that for services provided on other homepages linked through the homepage, the Company's privacy policy does not apply. In addition, the Company is not responsible for any personal information exposed due to reasons attributable to the Member. The Company strives to protect Members' personal information as stipulated by relevant laws and regulations. 2. The Company collects information about Members through information provided when Members apply for service use and other information provided in the process of using services, and Members' personal information is used for the purpose of providing services in accordance with these Terms. 3. The Company shall not disclose or distribute the personal information of Members acquired in connection with the provision of services to a third party without the consent of the individual, and shall not use it for commercial purposes. Provided that this does not apply in the following cases. (1) When there is a special provision in the law (2) When there is a request from the relevant agency in accordance with the procedures and methods prescribed for the purpose of investigation in accordance with the relevant laws and regulations (3) When requested by the Information and Communication Ethics Committee pursuantto relevant laws and regulations (4) When processing and providing a form that cannot identify a specific individual for academic research 4. If you do not use the service for one year, you may be converted to an inactive account. 5. The Company or a third party receiving personal information from the Company shall immediately destroy the personal information when the purpose of collecting or receiving personal information has been achieved. Provided that exceptions are made when it is necessary to preserve them in accordance with the provisions of the relevant laws and regulations. 6. In order to improve the quantity and quality of the services provided to the Members, the Company may provide and share the Member's personal information to a third party with the consent of the Member, and in this case, the scope of the personal information provided, the purpose of provision, and the third party to be provided shall be informed to the Member. 7. The Member may withdraw his/her consent to the collection and use of personal information provided to the Company at any time if he or she wishes, and if the Member withdraws, the consent shall be deemed to have been withdrawn. Article 16 (Provision and Notification of Information) 1. The Company may provide the Member with information deemed necessary during the use of the service by notice or e-mail. 2. If the Company notifies a large number of the Members, it may replace the individualnotification as a notice. Article 17 (Management of Postings) 1. Members are responsible for infringing the copyrights of others by the posts on the homepage posted by the Members. 2. The Company may delete the posting on the homepage without prior notice or consent if it violates the Company's policy or exceeds the prescribed posting period set by the Company. Article 18 (Exemption for Damages) 1. The Company shall not be liable if the service cannot be provided due to natural disasters, war or other force majeure reasons, resulting in damage to the Member. 2. The Company shall not be liable if the basic telecommunication service provider stops or fails to provide telecommunication services normally, resulting in damage to the Member. 3. The Company shall not be liable if the Member suffers damage due to unavoidable reasons such as repair, replacement, regular inspection, and construction of service facilities. 4. The Company shall not be liable if the Member suffers damage due to the failure of the service use due to reasons attributable to the Member. 5. The Company shall not be liable if the damage is caused by the Member's computer operation error, or if the Member is damaged by the Member falsely or incorrectly entering personal information. 6. The Company shall not be liable if the Member is damaged due to the data obtained while using the Service. In addition, the Company shall not be liable if the Member incurs damage due to reasons attributable to other Members while using the service. 7. The Company is not obliged to intervene in disputes arising between Members and between Members and third parties, and shall not be liable if damages occur to Members or third parties. 8. The Company shall not be liable if damage is caused to other Members or a third party due to the Member's intent or negligence in connection with the use of the Service. 9. The Company shall not be liable for any damage caused to the Member in connection with the use of the service provided free of charge to the Member unless it is intentional or gross negligence. Article 19 (Effort for Settlement of Disputes) The Company and Members shall make necessary efforts based on the principle of good faith to resolve disputes arising amicably in connection with the Service. Article 20 (Competent Court) The laws of the Republic of Korea shall apply to disputes arising from the use of services between the Company and the Member, and if a lawsuit is filed due to a dispute, the court having jurisdiction over the Company's principal location shall be the exclusive court. Addendum These Terms are effective from November 22, 2022.
